Considerar el Derecho como" objeto de estudio" no parece comportar ninguna novedad, sobre todo si nos ubicamos en un ambiente académico. De hecho, se da por sentado que, en efecto, el Derecho puede ser ese "objeto" por todos aquellos que escogen como área de formación profesional lo jurídico. El ejercicio que se lleva a cabo sobre él se torna casi siempre repetitivo y memorístico, pero pronto se aprende que, en la práctica, el resultado de erudición que ello produce rendirá buenos (...) frutos mañana. El estudiante "aprende derecho" apropiándose una terminología y adquiriendo la habilidad de ponerla en acto cuando sea el momento oportuno, haciendo así uso de una técnica que, sin embargo, no siempre producirá los resultados esperados. Una "técnica" cargada de albur. Las más de las veces, el ya profesional del derecho se consuela de sus tropiezos y fracasos "reconociendo" que "no siempre se tiene la razón" -en el mejor de los casos-, o acusando a propios y extraños de hacer un uso manipulativo o injusto de la herramienta. Se sabe que, además de lo competido que es el campo, se encuentra plagado de incertidumbres por la enorme carga de "subjetividad" que supone no solo su aplicación, sino la creación misma de sus componentes. This paper argues that habits, just like beliefs, can guide intentional action. To do this, a variety of real-life cases where a person acts habitually but contrary to her beliefs are discussed. The cases serve as dissociations showing that intentional agency is possible without doxastic guidance. The upshot is a model for thinking about the rationality of habitual action and the rationalizing role that habits can play in it. Divine names, i.e. the names religions use to speak of their god(s), pose a special problem to semantics. It is not only disputed whether they are proper names, descriptions, or names of kinds, the dispute between believers and non-believers over the ontological status of their bearers is a further obstacle to offering a single theory that can account for all divine names. But aboutness theory can come to the rescue here. Whatever terms divine names are, they pick out a subject (...) matter, and whereas ontology is relevant to reference, subject matters need no corresponding object in the world. Believers and non-believers can therefore agree on the name bearers’ status as topics of their conversation. (shrink)

In this review, I discuss recent advances in philosophical and psychological approaches to self-control. The review is divided in 4 parts, in which I discuss: a) different conceptions of self-control; b) standard methods for studying it; c) some models of how self-control is exercised; and d) the connections between self-control and other relevant psychological constructs. The review was originally commissioned by the John Templeton Foundation to provide an informative overview that would knit together different strands of current debates in the (...) field. This paper argues that “free will” is vague. The argument has two steps. First, I argue that free will is a matter of degrees and, second, that there are no sharp boundaries separating free decisions and actions and non‐free ones. After presenting the argument, I focus on one significant consequence of the thesis, although others are mentioned along the way. In short, considerations of vagueness help understand the logic behind so‐called manipulation arguments, but also show why these arguments are ultimately (...) flawed. (shrink)

El presente artículo es producto de una investigación multidisciplinaria e interinstitucional, fruto de la alianza entre la Universidad de San Buenaventura Medellín y el Centro de Familia VID-Obra de la Congregación Mariana de Medellín. Surge de una inquietud respecto a la manera en que se aborda la realidad institucional de las madres cabeza de familia, tanto en el ámbito político como empresarial. Para estudiar esta realidad, se partió de un modelo de investigación cualitativo, en donde se hizo una aproximación a (...) la población a partir de un cuestionario que permitiera identificar los roles y percepciones frente al ejercicio de la maternidad y la jefatura femenina, específicamente, cuando se trata de madres trabajadoras. Los resultados arrojados por la investigación permiten obtener una mirada psicosocial de la forma en que se ejerce el rol de madre y de figura de articulación familiar. (shrink)

Para ello, se ha trabajado con una muestra de estampas devocionales católicas perteneciente al Museo Histórico Nacional, las que corresponden a imágenes del Sagrado Corazón en sus distintas variantes. Sostengo que el carácter háptico de las imágenes es fundamental para la mirada religiosa y las formas de la creencia, evidenciando los mecanismos de persuasión que estas imágenes comportan, así como sus (...) implicaciones táctiles, visuales y corporales. En este artículo se sostiene que existe una primacía de la práctica y la acción sobre el conocimiento intelectual y la contemplación. Si esta tesis fuese falsa, no resulta comprensible por qué la prudencia y el hombre prudente son la virtud suprema y el modelo de la vida buena en Aristóteles. La cuestión inicial es 1) ¿Cómo entender la racionalidad del deseo o qué significa deseo razonado?, y esto implica dos cuestiones adicionales: 2) ¿Qué es el silogismo práctico y qué (...) relación tiene con la recta razón? y 3) ¿cuál es la relación entre el razonamiento práctico, la prudencia y el hombre prudente? Estas cuestiones son analizadas para establecer algunas de las semejanzas y diferencias entre el silogismo práctico , los diversos tipos de inferencias prácticas y otros tipos de razonamientos, tratando de mostrar la relación que existe entre la formación del carácter o modo de ser, la recta razón y el silogismo práctico. En este breve comentario discuto algunos aspectos de la interpretación de la epistemología de Davidson que sugiere Willian Duica en su reciente libro. Luego de una presentación somera del libro me centro en tres asuntos centrales de la interpretación de Duica. En primer lugar, argumento que su lectura de la crítica de Davidson al dualismo esquema/contenido es muy restrictiva y deja abierta la posibilidad de un realismo directo empirista. En segundo lugar, argumento que en su lectura el propio Duica se (...) compromete inadvertidamente con un empirismo de este tipo y, de este modo, su interpretación entra en tensión con el coherentismo de Davidson. Finalmente, discuto algunos aspectos de la interpretación que hace Duica de la tesis davidsoniana de la triangulación. In this short comment I discuss some aspects of William Duica's interpretation of Davidson's epistemology in a recent book. After a brief review of the book, I focus on three central issues of Duica's interpretation. First, I argue that his reading of Davidson's criticism of the scheme/content dualism is too restrictive and leaves open the possibility of an empiricist direct realism. Second, I argue in his reading Duica inadvertently commits himself to an empiricism of this sort and, as a result, his interpretation is in tension with Davidson's own coherentism. Finally, I discuss some aspects of Duica's interpretation of Davidsonian triangulation. (shrink)

This is a draft of my chapter on Agency and Mistakes for the Routledge Handbook of Philosophy of Agency. In it, I focus on performance mistakes and distinguish them from other "derivative" mistakes that we make as agents. I argue that a proper understanding of these mistakes recommends a generalized fallibilism about human agency.

What is the role and value of virtue, emotion and imagination in law and legal reasoning? These new essays, by leading scholars of both law and philosophy, offer striking and exploratory answers to this neglected question. The collection takes a holistic approach, inquiring as to the connections and relations between virtue, emotion and imagination. In addition to the principal focus on adjudication, essays in the collection also engage with a variety of different legal, political and moral contexts: eg criminal law (...) sentencing, the Black Lives Matter movement and professional ethics. A number of different areas of the law are addressed and the issues explored include: the benefits and limits of empathy in legal reasoning; the role of attention and perception in judicial reasoning;, the identification of judicial virtues and judicial vices ; the values and dangers of certain imaginative devices ; and the interactive and social dimensions of virtue, emotion and imagination. This chapter examines coherentist approaches to the justification of normative judgments in law. First, it provides a survey of the main approaches to normative coherence defended in the literature on legal coherentism and discusses the principal objections that threaten to undermine the coherence theory of legal justification. One problem with coherentism, namely the problem of the coherence bias, has not, however, received enough attention in the literature. This chapter states this problem in detail and argues that a modified version of (...) legal coherentism—namely virtue coherentism—has the resources to address this problem. The chapter then engages in a second-order debate about the relevance of coherence in justification by inquiring into the reasons why coherence is worth pursuing when reasoning in law. Finally, this chapter concludes by assessing the value and limits of coherentist reasoning in the legal domain. (shrink)

RESUMEN En este artículo propongo revisar las aproximaciones de Mabel Moraña y Antonio Cornejo Polar al clivaje paradigmático entre las figuras de José María Arguedas y Mario Vargas Llosa en la cultura latinoamericana. En ese marco, tanto Cornejo Polar como Mabel Moraña desarrollan, en su propio lenguaje, preguntas por los dispositivos de poder y por las estrategias de resistencia que derivan de las relaciones entre literatura y máquinas sociales planteadas por Deleuze y Guattari, en una perspectiva decolonial. Este será el (...) contenido de la primera parte. En la segunda, quisiera seguir el derrotero de Cornejo Polar en la creación del concepto de 'subjetividad heterogénea', que condensa la experiencia de la migración interna en los países andinos y está presente con especial intensidad lingüística y performativa en El zorro de arriba y el zorro de abajo, la última obra de Arguedas. ABSTRACT This article intends to review the approaches of Mabel Moraña and Antonio Cornejo Polar to the paradigmatic cleavage between the figures of José María Arguedas and Mario Vargas Llosa in Latin American culture. Within this framework, both Cornejo Polar and Mabel Moraña develop, in their own language, questions about power devices and resistance strategies derived from relationships between literature and social machines raised by Deleuze and Guattari, from a decolonial perspective. This will be the content of the first part. In the second, it would like to follow Cornejo Polar's path in creating the concept of 'heterogeneous subjectivity', which condenses the experience of internal migration in the Andean countries and is present with particular linguistic and performance intensity in El zorro de arriba y el zorro de abajo, the last work of Arguedas. The university that Alasdair MacIntyre defines as liberal is that which rejects the tradition as something pre-modern and with an impediment for the progress, including the pedagogic one. This university model has been extended in all instances, giving priority to the technical education in a pragmatic way. Thus, the global and sapiential vision of the university has been relegated. This last approach is the key for unifying the knowledge and to pass it onto other people and, therefore, to educate and (...) mold intellectually and morally. However, the professionalization of the philosophy and the criteria of the modern liberalism seem to dominate and inspire most universities in the present day. This situation has plainly shown an inability to become aware of their incompetence to properly educate professors and students alike, in a sapiential and moral manner, threfore deceiving themselves with a naive rhetoric. Disasters and public health emergencies raise a variety of ethical dilemmas, often including those that require balancing the best interests of individuals against those of groups or communities. The on-going COVID-19 pandemic provides examples of these ethical conflicts, as do other recent outbreaks. Decisions and actions in this context must address different ethical issues, ranging from those directly related to autonomy, consent, privacy and confidentiality to those related to interventions and technologies, such as efficacy, effectiveness, safety and fair access. This (...) paper aims to identify ethical conflicts with complex resolutions involving aspects related to values, rights and needs of individuals and the collective, and to suggest how such challenges could lead to more positive experiences and outcomes when confronted in future emergencies. The body as an object of the violence generated in the framework of the Colombian armed conflict occupies a central place in different works of art and literature in the country. In various cases, such centrality is due to the commitment of the authors to resignify the occurrence of massacres, kidnappings, disappearances or forced displacement, which involve or fall on the bodies of the victims. Such is the case of the works analyzed comparatively in this article: the installation Signos cardinales (...) by Libia Posada and the novel En el brazo del río by Marbel Sandoval. Both of these works converge in the resignification of the body in the context of forced displacement. Among the objectives, it seeks to define the way in which a cartographic narrative is configured in the works. It is also intended to reflect on the relationship between the body and forced displacement: internal and cross-border. The analysis proposed here revolves around the concept of cartographic narrative, which will be approached from, on the one hand, Ítalo Calvino, who defines cartography as a space-time union articulated in the idea of ​​itinerary; and on the other, by Michel de Certeau, since he considers the narrative structures, implicit in cartography, as a spatial syntax, that is, a notion that allows us to address the representation of forced displacement as a symbolic delimitation of reordering itineraries of space. In recent years coherence theories of law and adjudication have been extremely influential in legal scholarship. These theories significantly advance the case for coherentism in law. Nonetheless, there remain a number of problems in the coherence theory in law. This ambitious new work makes the first concerted attempt to develop a coherence-based theory of legal reasoning, and in so doing addresses, or at least mitigates these problems. The book is organized in three parts. The first part provides a critical analysis (...) of the main coherentist approaches to both normative and factual reasoning in law. The second part investigates the coherence theory in a number of fields that are relevant to law: coherence theories of epistemic justification, coherentist approaches to belief revision and theory-choice in science, coherence theories of practical and moral reasoning and coherence-based approaches to discourse interpretation. Taking this interdisciplinary analysis as a starting point, the third part develops a coherence-based model of legal reasoning. While this model builds upon the standard theory of legal reasoning, it also leads to rethinking some of the basic assumptions that characterize this theory, and suggests some lines along which it may be further developed. Thus, ultimately, the book not only improves upon the current state of coherence theory in law, but also contributes to the larger debate about how to articulate a theory of legal reasoning that results in better decision-making. We present a Hilbert-style axiomatization of a recently introduced logic, called G'3 G'3 is based on a 3-valued semantics. We prove a soundness and completeness theorem. The replacement theorem holds in G'3. As it has already been shown in previous work, G'3 can express some non-monotonic semantics. We prove that G'3can define the same class of functions as Lukasiewicz 3 valued logic. Moreover, we identify some normal forms for this logic.

This is a draft of my chapter on Negligence for the forthcoming Oxford Handbook in Moral Psychology. It discusses philosophical, psychological, and legal approaches to the attribution of culpability in cases of negligent wrongdoing.

Hasta ahora, las discusiones sobre el multiculturalismo se han presentado como una revisión progresista de los límites del liberalismo en cuanto a políticas de inclusión y reconocimiento. Este artículo plantea que la recepción del multiculturalismo en Latinoamérica, si no quiere ser puramente procedimental, puede plantearse como una deconstrucción de los conceptos de Sujeto y Estado. Para ello hemos adoptado el punto de vista de comunidades étnicamente diferenciadas (que Deleuze y Guattari han categorizado como máquinas territoriales), de modo que sus relaciones (...) de poder y sus procesos de subjetivación puedan ser vistos como expresión de lo intraestatal y lo preindividual, respectivamente. Aunque esta diferencia de perspectiva se plantea, básicamente, como un diferendo entre teorías, al final se sugieren criterios para un debate más amplio sobre las relaciones entre Estado y capitalismo alrededor de las condiciones de existencia de las sociedades premodernas. En este artículo se presenta la importancia que le da Hannah Arendt al relato histórico y ficticio como vía para la reflexión ética y política. Se estudia, en primer lugar, cómo los relatos posibilitan la configuración de la identidad, tanto de un hombre como de una comunidad, ya que la narración permite dar sentido a la fragilidad y contingencia propia de las acciones humanas. En segundo lugar se analiza de qué manera la narración permite conservar en la memoria acciones para (...) que no sean olvidadas. Finalmente se estudia cómo el seguimiento de relatos contribuye a la comprensión del mundo humano y a potenciar la facultad de juzgar para superar pensamientos solipsistas, elemento necesario para el ejercicio de una concepción ética y política basada en el reconocimiento de la pluralidad humana. El artículo tiene la finalidad de explicar las dificultades existentes cuando las interpretaciones filosóficas sobre los hechos del pasado se basan en marcos conceptuales contemporáneos. En especial, cuando la intención de los autores se centra en tratar encajar los acontecimientos del pasado a lenguajes políticos modernos. Para alcanzar tal fin, me sirvo de las narraciones filosóficas dedicadas a la independencia de la Nueva España; en especial, la que efectúa el filósofo Enrique Dussel en su libro Política de la liberación. Mi (...) intención es vislumbrar los problemas hermenéuticos profundos cuando la intención de los autores se centra en realizar lecturas políticas del pasado, en vez de tratar de comprender los mundos de la vida de épocas pretéritas. This article explores the sources of the concept of difference advanced by Deleuze and, in particular, the idea of a non-phenomenological difference, understood as internal difference. In the first part, Deleuze’s appropriation of the concepts of memory and duration proposed by Bergson is explored, as if it corresponded with a response to Heidegger’s systematization of Nietzsche, thus opening the concept of forces to others such as heterogeneity, relativity, and multiplicity. The second part contains a dicussion of the hypothesis according to (...) which the immersion in the Bergsonian synthesis of time results in the justification for the reformulation of the eternal return as repetition, the distinctively deleuzian problem of internal difference, and the concept of virtual as the definitive sign of a new plane of immanence for thought. The article concludes by presenting the internal difference from the outside that overflows it and makes it mutate in the whole of Deleuzian philosophy. (shrink)

Los desafíos que el Sínodo de la Amazonía presenta a la teología son trabajados en el horizonte de la pregunta por el estatuto epistemológico de la teología, a partir del uso de algunas metáforas empleadas por los textos del Sínodo. En este trabajo se requiere asumir una clave de lectura intertextual y un método que justifique la centralidad de las metáforas y su dinamismo de préstamo con relación a la fundamentación teológica. Las metáforas empleadas por los documentos sinodales dan qué (...) pensar a la teología con relación a su constitución interna. Le abren el camino para comprenderse de otra manera. Ese es el caso de: la eclesiología, lo propio del lenguaje teológico, las conversiones y actitudes para el quehacer de la teología, el lugar de la ritualidad y el valor de lo local con relación al intellectus del misterio y al depósito de la fe, la interculturalidad y la sinodalidad, entre otros. Philosophical accounts of moral responsibility are standardly framed by two platitudes. According to them, blame requires the presence of a moral defect in the agent and the absence of excuses. In this chapter, this kind of approach is challenged. It is argued that (a) people sometimes violate moral norms due to performance mistakes, (b) it often appears reasonable to hold them responsible for it, and (c) their mistakes cannot be traced to their moral qualities or to the presence of excuses. This paper defends a version of the Simple View, the claim that someone intentionally φs only if the person intends to φ. To do this, I raise a problem for Bratman’s classic argument (1984, 1987) against it. The problem brings into focus an evaluative dimension behind the View, whose recognition allows for an improved version of it. With this improved version, I then go on to answer other criticisms that have been raised to it.

Brutus’ De virtute, a lost work that had important but overlooked influence on Cicero’s ethical dialogues, is more dependent on Antiochus’ ethics than has been recognized. In reviewing the sources for De virtute, I arrive at a conception of Brutus’ work as a consolation written in a fundamentalist—rather than ecumenical—mode that focalizes its arguments and commonplaces from the perspective of Antiochus’ philosophical system. This conception is supported by the only other testimony for Brutus’ consolatory writing.

Resumen: Este escrito es un ensayo que busca tensionar el lugar de las imágenes en la experiencia religiosa, proponiendo que toda mirada religiosa es una mirada háptica, por tanto, una visualidad impura que involucra la corporalidad, el tacto y la cercanía de modo des-jerarquizado. La propuesta de este ensayo se basa en las metodologías visuales críticas, y se despliega a partir de una constelación de imágenes que muestran diversos lugares del cuerpo en un sentido religioso, comprometiendo algunos de sus elementos, (...) tales como el alma, la boca y el corazón. Se examinan imágenes en su relación con otras imágenes, objetos y oraciones, organizadas en series temáticas en función de su foco corporal. Las imágenes revisadas comienzan con una serie de la muerte de Santa Rosa de Lima, se concentran luego en la herida corporal en algunas iconografías de santos relativos al sagrado corazón de Jesús y termina en un conjunto de imágenes donde los corazones se independizan del cuerpo.: This essay aims to add further tension to the role of images in relation to religious experience, affirming that every sacred gaze is a haptic gaze, which is to say, a particular way of engaging with images through corporeality, proximity and touching in a non hierarchical way. The proposals exposed here are based on critical visual methodologies and it unfolds from a constellation of images emphasizing certain body parts in a religious sense, highlighting some of their elements, such as the soul, the mouth and the heart. These images are put in relation to other images, objects and prayers, and are organised in thematic series following their function on the corporal focus. The selected images comprise a series of Santa Rosa de Lima’s deathbed, then the attention goes to the exposed wounds of some saints devoted to the Sacred Heart of Jesus, and it ends in a group of iconographies where hearts are depicted independently of the body.
